Without limiting the forgoing, under no circumstances shall Web-Beacon, or any members of the Web-Beacon staff or its volunteer editors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including without limitation Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Requests for Removal of Links

Web-Beacon indices consist of information that has been identified, reviewed, indexed and compiled by human beings. Web-Beacon occasionally receives requests from people to remove links from its indices. Although Web-Beacon reserves the right to address such requests individually, the general principles for such actions are as follows.

Web-Beacon would consider on a case-by-case basis requests to remove the link to a site from its indices. For each Web site reflected in Web-Beacon indices, Web -Beacon may remove links if either

1. A site owner restricts access to his or her Web site or
2. A site is taken down from the Web, or
3. A site is placed in an inappropriate category, or
4. A site's content has changed significantly.

A site owner or a third party, in any of these instances should contact Staff@Web-Beacon.com to submit a request for link removal. Web-Beacon reserves the right, at our discretion, to remove links or to take action on your request.

Automatic Querying

You may not send automated queries of any sort to the Web-Beacon server. Note that 'sending automated queries' includes, but is not limited to:

• Using any computer software or programs whether online or otherwise, which sends queries to Web-beacon's server to determine how a Web site or page 'ranks' in
• Web-Beacon search results page, for various keywords, phrases, and/or queries.
• Using any computer software or program whether online or otherwise, which sends automated submissions to Web-Beacon's Add URL pages.
• Using any computer software or program whether online or otherwise which sends queries to Web-Beacon's server for any reason whatsoever.
• Meta searching Web-Beacon

Spoofing HTTP headers for the purposes of hiding the source of the query, is prohibited.

Persons who violate Web-Beacon's TOS run the risk of having their site(s) permanently removed from Web-beacon and may face legal repercussions.

Miscellaneous Provisions

These Terms of Service will be governed by and construed in accordance with the laws of the State of Indiana, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by Web-Beacon.
